3. Season Tickets, Mini Ticket Plans, Group Tickets, and Suites. Any suite purchases are also subject to the terms and conditions of the applicable BLFC suite agreement, which are incorporated herein, and shall control in the event of any conflict with these Terms.
4. Secondary Purchasers. Unless otherwise specified, all rights and remedies arising from or relating to the purchase, transfer, or pricing of a Ticket under these Terms inure solely to the benefit of the Original Purchaser. Any rights or remedies of a Secondary Purchaser arising from or relating to the purchase, transfer, or pricing of a Ticket must be asserted solely against the applicable Ticket reseller, secondary marketplace, or Ticket Agent, and not against BLFC.
5. Ticket Transfer. If Holder cannot attend an Event for any reason, no refunds, credits, or exchanges will be provided, however, Holder is welcome to transfer or sell their Ticket to another fan. Each Ticket transfer or sale through Ticket Agent, Account Manager, and certain other third-party secondary market sellers may generate a new, unique barcode associated with that Ticket for that Event, which may invalidate any previously issued Ticket barcode for the same seat(s). By instructing BLFC or Ticket Agent to forward, distribute, transfer or sell a Ticket, you authorize Ticket Agent and BLFC to issue to the recipient a valid Ticket complete with full rights due and owing to any valid Holder and to cancel and invalidate any Ticket previously issued for admission at the same Event. Misuse of the transfer, resell, or forwarding features for all Tickets may result in a revocation of Holder’s revocable Ticket license. In addition, purposefully misrepresenting any seat location information through any platform may result in the revocation of the revocable Ticket license for any future matches purchased by the same Holder. BLFC is not responsible for a misleading or purposely misrepresented seat location that is purchased on the secondary ticket resale market. BLFC reserves the right not to replace or honor lost, destroyed, duplicated, counterfeit, stolen, or otherwise invalid Tickets. This Ticket is not redeemable for cash and shall not be used for, or in connection with, any commercial or trade purposes including, but not limited to, advertising, promotions, contests, sweepstakes, giveaways, gambling or gaming activities, without the express written consent of Management. Any fraudulent transfer, resales, double distributions, and invalid copies of barcodes, in whatever form, are invalid and may be refused or rejected at the point of entry or ticket scan for an Event. Notwithstanding the foregoing, Management may restrict the onward transfer or sale of any Ticket to any Event by Original Purchaser for any reason.
6. Ticket Brokers. If, at any time, it is determined that Holder purchases any Ticket with the intent to resell such Ticket and is therefore operating, in BLFC’s exclusive discretion as a Ticket Broker, BLFC may suspend the Holder’s Account Manager, suspend or revoke any outstanding unused Ticket without refund, and prevent them from purchasing any new Ticket in the future. For purposes of these Terms, a “Ticket Broker” means any person or entity that purchases or acquires Tickets with the intent to resell, distribute, or commercially exploit such Tickets, whether as a business or otherwise, as determined by BLFC in its sole discretion, including based on purchase or transfer patterns, use of multiple accounts, circumvention of Ticket limits, automated purchasing tools, or the provision of false or misleading information to disguise the purchaser’s identity. BLFC does not guarantee any Ticket to any Event purchased from a Ticket Broker. This Section does not prohibit bona fide, non-commercial Ticket transfers or resales by a Holder in accordance with Section 5, and all Tickets, including those sold or transferred by a Ticket Broker, remain subject to these Terms.
7. Account Data. As a condition for the purchase of any Ticket, all Original Purchasers (and any Secondary Purchaser whose information is provided to BLFC) agree to provide BLFC and/or Ticket Agent with Account Data, which must be true, accurate, complete, and current at all times. BLFC is not responsible for any issues arising from untrue, inaccurate, incomplete, or outdated Account Data. BLFC may collect, use, and share Account Data in accordance with its Privacy Policy, including for purposes of administering and fulfilling Tickets and Events, communicating Event-related information (including reschedules or cancellations), complying with legal or security requirements, preventing fraud or misuse, and providing marketing communications. Any attempt by Holder to provide false, misleading or fraudulent information, or to misuse an Account Manager, may result in revocation of Ticket licenses without refund.
8. Stadium Security and Entrance Requirements. Holder acknowledges and agrees that admission to the Event may be refused or Holder may be ejected, in each case without refund, at the sole discretion of Management, including if Holder’s conduct violates these Terms, any applicable code of conduct, or any applicable federal, state, or local law or governmental order, or is otherwise disorderly or abusive. Holder acknowledges and agrees that Management, or any federal, state, or local governmental jurisdiction, may at any time deploy any measure to keep fans, Event participants, and employees and staff safe at Stadium. These policies and procedures may utilize, employ, change, alter, or amend security screening, ingress and egress, including but not limited to health check points, temperature screenings, vaccine verification requirements, mask requirements and other safety and security policies, including the size, shape, and type of bags allowed inside and any items prohibited from any or all Events. For a current list of all prohibited items and for the then current bag and security policy please consult the Stadium Terms (as defined below), as applicable. In addition to security and health screenings, Management may develop, amend, adapt, or modify policies at any time, and with little notice to fans, to limit the spread of communicable disease, pathogen or virus, in Management’s sole discretion or as required by any applicable federal, state, or local law or governmental order. Holder consents to and waives any claim based on such searches or assessments, and agrees that failure to consent may result in denial of entry or revocation of admission, without refund.
9. Stadium Terms. For any Event held at Gillette Stadium or Centreville Bank Stadium, Holder acknowledges and agrees that admission to the Stadium is conditioned upon its acceptance of the terms and conditions applicable to such Stadium, including (i) https://www.gillettestadium.com/ticket-terms/ for any Event held at Gillette Stadium, and (ii) https://www.rhodeislandfc.com/ticket-terms-spectator-waiver/ for any Event held at Centreville Bank Stadium (collectively, the “Stadium Terms”). The Stadium Terms are incorporated into and made a part of these Terms. In the event of any conflict between these Terms and the Stadium Terms, these Terms shall control.
10. Fan Code of Conduct. All Holders agree to comply with all directions from Management staff, including alcohol enforcement, security services, and guest service representatives. Abusive behavior is grounds for removal from Stadium. Any violations of these Terms may result in immediate removal of the Holder and/or their companions and other disciplinary measures, including suspension from future matches or longer bans on attending. BLFC supports an inclusive culture where all fans are and feel welcomed and will not tolerate any racist, homophobic, xenophobic, sexist, transphobic or other hateful, demeaning speech directed at any other individual or group of people.
11. League Rules. These Terms may be amended from time to time in order to comply with NWSL rules regarding Ticket purchases (collectively “League Rules”). Without limiting the foregoing, the League Rules include among other things, the NWSL’s Fan Code of Conduct and Pledge to Fans, available at https://images.nwslsoccer.com/image/private/t_q-good/prd/idi8d48vs7lkbwpy3v7h.pdf.
12. Holder Personality Release. Holders hereby grants to Management, and their respective sponsors, licensees, promoters, advertisers, and broadcasters, on behalf of Holder and Holder’s minor children or wards the irrevocable, perpetual, and unrestricted right and permission to photograph, record, film, capture, use, publish, reproduce, edit, alter, create derivative works from, and otherwise exploit Holder’s (and such minors’) image, likeness, voice, actions, statements, name, and appearance to the extent captured during any Event and related activities, promotional activities, pre-match/in-match/post-match experiences and all other in-Stadium activities, and any broadcast or transmission thereof, in whole or in part, in any media now in use or hereafter created, for any purpose whatsoever, including commercial purposes, without further authorization or compensation. Holder hereby waives any and all claims or potential claims relating to such use, including rights of publicity or privacy, to the maximum extent permitted by applicable law.
13. Holder’s Limitation on the Transmission of Works. Holder will not create, transmit, display, distribute, exploit, misappropriate or sell (or aid in such activity) any description or account, in any form, whether text, data or visual, and including, without limitation, play-by-play data, any photographs, images, videos, livestreams, audio or other form of display or public performance or reproduction of any portion of the Event (the “Works”) for any commercial, non-personal, purpose. Notwithstanding the foregoing, Holder agrees that by using this Ticket to enter Stadium, Holder shall be deemed to have signed this Ticket and granted Management an exclusive worldwide, irrevocable, perpetual, sub-licensable, royalty-free license to all rights associated with the Works.
14. Acknowledgement of Risks; Release and Waiver of Liability.
Holder acknowledges and agrees that it voluntarily assumes all risks, hazards and dangers arising from or relating in any way to the Event, whether occurring before, during or after the Event, including without limitation the risk of contracting Covid-19 or any other communicable disease or illness (including exposure to a bacteria, virus or other pathogen capable of causing a communicable disease or illness), the risk of physical injury or death, however caused, whether by players, by other people or by objects such as balls entering the spectator area, or otherwise, and the risks of lost, stolen or damaged property. Holder further acknowledges that, if provided access to pitch-side or field-level areas at the Stadium, such areas may present additional hazards, including uneven or slippery surfaces, walking on turf or concrete, stepping over cables, cords, or other infrastructure, and exposure to weather elements.
